Tootor.ca is operated by NewArts Toronto (also referred to as “us”, "our", or “we” herein). Newmarket Community Music and Arts Centre is NewArts Toronto's legal name and is a registered Canadian non-profit charitable organization.

 

These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers online tutoring and educational resources. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

Services

We provide online tutoring services in Math, English, and Science subjects in accordance with the Ontario Curriculum through the website tootor.ca. The service is intended to provide students with access to qualified tutors who can help them with their academic needs. The service is not intended to replace classroom instruction or to be a substitute for professional educational advice.

If you wish to use any product or service made available through our website, you may be asked to supply certain information relevant including, without limitation, your name, address, email, age and level of education.

Eligibility

In order to use our website and/or receive our services, you must be either of the following:

  • Individuals over age 18 (or over age 13 with consent of their parents/guardians), who have sufficient competence, experience and ability to provide online tutoring support to Ontario students (“Volunteers”); and/or

  • Individuals who are seeking tutoring services for themselves or their child (“Service Recipients”). There is no age requirement for Service Recipients except that you either must be over age 18 or have consent of a parent/guardian if under age 18.

You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

 

Volunteers who wish to provide online tutoring services to Service Recipients are solely responsible for ensuring they have any applicable authorization, capacity or insurance to provide this support. By submitting the volunteer application form you consent to us doing background checks on you which may include criminal records checks, social media checks and/or verifying identity.

 

In order to provide, access or use some or a portion of the services as either a Volunteer or a Service Recipient, you may be required to register with us using the Sign Up form provided on the website and provide us with your contact information.

Fees

We charge a monthly subscription fee for the use of the service. The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time.

Cancellation Policies
Cancellation

We understand that sometimes it may be necessary to cancel a tutoring session. Therefore, we have developed the following cancellation policy to ensure that both our students and tutors are treated fairly.

  • Student Cancellation Policy: If a student needs to cancel a tutoring session, we require that they notify the tutor at least 8 hours before the scheduled session time. Acceptable methods of cancellation include cancelling the session via the My Bookings page or emailing the tutor. We ask that students avoid last-minute cancellations since tutors spend a significant amount of time preparing for each session.

  • Tutor Cancellation Policy: If a tutor is unable to attend a tutoring session scheduled in more than 48 hours, they must notify us so that we would be able to work to find a substitute tutor. If a tutor needs to cancel a session scheduled in less than 48 hours, they must cancel the session via their Wix calendar and inform the student. We ask that tutors avoid last-minute cancellations since it can be disruptive and frustrating for students who may have already set aside time to attend the session and it can also impact the student's learning progress and delay their academic goals.

Personal Information

You recognize and agree that by uploading any content (including, but not limited to certain information, text, graphics, videos, or other material) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You are responsible for the ongoing maintenance and updating of your information, and agree and consent that the uploaded/transferred content may be publicly displayed at the website.

Right to Suspend or Cancel User Account

We may permanently or temporarily terminate or suspend your access to our services without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

Indemnification

You agree to indemnify and hold Newmarket Community Music and Arts Centre and their respective directors, managers and employees harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

Limitations of Liability

Newmarket Community Music and Arts Centre will not be liable for any loss or damage arising from the use of the service, including but not limited to any errors or omissions in the content provided.

 

We will not be liable for any loss or damage arising from the performance or conduct of any Volunteers.

 

We will not be liable for any indirect, consequential, or incidental damages, or any loss of profits, revenue, or data, arising from the use of the service.

We cannot be held responsible for any copyright or licensed material that Volunteers may select to use.

We have no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services that are linked to our website or recommended by us. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

Right to Change and Modify Terms

We reserve the right to modify or replace these terms at any time at our sole discretion. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Governing Law

These terms and conditions and the use of the service will be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without giving effect to any principles of conflicts of law.
